Welcome to BLUCK Europe.

These Terms of Service govern your use of our website, online store, products and related services.

Throughout these Terms, “BLUCK Europe”, “BLUCK”, “we”, “us” and “our” refer to the operator of this store.

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and services to you.

By accessing our website, creating an account or placing an order, you agree to these Terms of Service together with our Privacy Policy, Shipping Policy and Return & Refund Policy.

Please read these Terms carefully before using our Services or placing an order.

Nothing in these Terms limits or excludes any mandatory rights you may have under applicable consumer protection law.

SECTION 1: ACCESS AND ACCOUNT

You may browse our website without creating an account. Certain features may require you to provide information such as your name, email address, billing information or delivery address.

You agree that any information you provide is accurate, current and complete.

You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account where that activity results from your failure to keep those credentials secure.

You must not use another person's account without permission or use our Services for fraudulent, unlawful or abusive purposes.

We may suspend or restrict access to an account where we reasonably believe that it is being used fraudulently, unlawfully, in breach of these Terms or in a way that may compromise the security of our Services.

SECTION 2: OUR PRODUCTS

We make reasonable efforts to ensure that product descriptions, photographs, specifications and other information displayed on our website are accurate.

However, colours, finishes and appearance may vary slightly depending on lighting, photography, screen settings, manufacturing tolerances and ongoing product improvements.

Images and product renders are provided for illustrative purposes. Minor differences that do not materially affect the essential characteristics, functionality or quality of a product may occur.

The product supplied will nevertheless conform to the description and characteristics forming part of your contract as required by applicable law.

BLUCK aroma inhalers are consumer lifestyle products. Unless expressly stated otherwise, they are not medicines or medical devices and are not intended to diagnose, treat, cure or prevent any disease or medical condition.

BLUCK products should always be used in accordance with the instructions supplied with the product.

Individual experiences may vary. We do not guarantee any particular behavioural, lifestyle, therapeutic or smoking cessation outcome from using a BLUCK product.

We reserve the right to discontinue products, modify non-essential product characteristics or introduce product improvements at any time. Any such changes will not affect an order already accepted by us unless agreed with you or otherwise permitted by law.

SECTION 3: ORDERS

When you place an order through our website, you are making an offer to purchase the selected products.

An automated order confirmation confirms that we have received your order. It does not necessarily mean that your order has been accepted.

Unless applicable law requires otherwise, acceptance occurs when we confirm that your order has been accepted for fulfilment or dispatched.

Before acceptance, we may decline or cancel an order for legitimate reasons, including:

• Product unavailability
• An obvious pricing or product information error
• Payment not being authorised
• Suspected fraud or unauthorised payment activity
• Shipping restrictions affecting the destination
• Legal or regulatory restrictions
• Unusually large quantities that reasonably appear to be intended for unauthorised commercial resale

If we cancel an order after payment has been collected, the relevant amount will be refunded using the original payment method without undue delay.

Please review your order carefully before submitting it.

If you need to change or cancel an order, contact us as soon as possible. Once fulfilment has begun or the order has been dispatched, we may not be able to make changes.

Returns, withdrawals and refunds are governed by our Return & Refund Policy and your applicable statutory consumer rights.

Retail purchases through our online store are intended primarily for personal use. Commercial, reseller or wholesale purchases may be subject to separate terms agreed with BLUCK Europe.

SECTION 4: PRICES, TAXES AND PAYMENT

Prices, discounts and promotions may change from time to time. Changes will not affect orders already accepted by us.

The price applicable to your purchase is the price displayed and agreed when you place your order, subject to correction of obvious errors before acceptance.

Prices displayed to consumers include applicable taxes where required by law.

Shipping charges and any other applicable costs will be displayed before you complete your purchase.

For destinations outside the European Union, local customs duties, import taxes or other charges may apply unless expressly stated as included.

You agree to provide accurate and complete billing and payment information and confirm that you are authorised to use the payment method provided.

Payments may be processed securely by third party payment providers. BLUCK Europe does not necessarily receive or store your complete payment card details.

Promotional codes, discounts and offers may be subject to separate conditions. Unless expressly stated otherwise, promotions cannot be combined.

We reserve the right to correct obvious pricing, discount or promotional errors before accepting an order.

SECTION 5: SHIPPING AND DELIVERY

Orders are shipped in accordance with our Shipping Policy.

Delivery times displayed on our website or during checkout are estimates unless expressly stated otherwise.

Orders are normally processed within the timeframe stated in our Shipping Policy.

Delivery may occasionally be affected by circumstances outside our reasonable control, including carrier disruption, customs procedures, public holidays, severe weather, exceptional demand or other unforeseen events.

Where BLUCK Europe arranges delivery, risk of loss or damage remains with us until the goods are physically received by you or by a person you have designated to receive them.

This does not apply where you independently commission a carrier that was not offered by us, to the extent provided by applicable law.

You are responsible for providing a complete and accurate delivery address.

If delivery fails because an incorrect or incomplete address was provided, a parcel was refused, or the customer failed to complete a required delivery or customs procedure, we may charge reasonable and directly incurred costs associated with returning or reshipping the order where permitted by law.

This does not affect your rights where the delivery problem was caused by us or by a carrier appointed by us.

SECTION 6: INTELLECTUAL PROPERTY

The content available through our website, including the BLUCK name, trademarks, logos, product designs, photographs, graphics, videos, text, packaging, illustrations and website content, is owned by or licensed to BLUCK Europe and is protected by applicable intellectual property laws.

You may access and use our website for personal and non-commercial purposes.

You may not reproduce, copy, modify, distribute, sell, commercially exploit or create derivative works from our protected content without our prior written permission, except where permitted by law.

Nothing in these Terms grants you ownership of or a licence to use BLUCK trademarks, product branding or other intellectual property except as necessary for ordinary personal use of our Services.

Shopify and other third party names and trademarks belong to their respective owners.

Our website may provide access to tools, payment services, applications or other functionality operated by third parties.

We are not responsible for the independent operation of third party services that we do not control.

Your use of those services may also be subject to the third party provider's own terms and privacy policies.

Nothing in this section excludes any responsibility that BLUCK Europe is legally required to assume in relation to your purchase.

SECTION 9: RELATIONSHIP WITH SHOPIFY

Our online store is powered by Shopify.

Shopify provides the ecommerce technology used to operate the store but is not the seller of BLUCK products.

Purchases made through our store are contracts between you and BLUCK Europe.

BLUCK Europe remains responsible for its obligations to you as the seller under applicable law.

SECTION 10: PRIVACY

Personal information collected through our Services is processed in accordance with our Privacy Policy.

Because our store is hosted by Shopify, certain personal information may also be processed by Shopify and by service providers necessary to operate our store, process payments, prevent fraud, fulfil orders and provide customer support.

SECTION 11: REVIEWS AND FEEDBACK

If you voluntarily submit a product review, photograph, comment, suggestion or other feedback to us, you confirm that you have the right to provide that content.

You grant BLUCK Europe a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, adapt and share that content for purposes connected with operating, improving and promoting BLUCK Europe and its products, to the extent permitted by law.

We may moderate or remove content that is unlawful, fraudulent, abusive, misleading, infringes third party rights or is otherwise inappropriate for our Services.

We will not knowingly alter a genuine customer review in a way that materially changes the customer's opinion.

Products supplied by BLUCK Europe must conform to the applicable sales contract and mandatory consumer protection requirements.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by our acts or omissions, fraud or fraudulent misrepresentation, or mandatory statutory consumer rights.

Subject to the above and to the extent permitted by law, BLUCK Europe is not responsible for losses that were not reasonably foreseeable when the contract was entered into or losses caused solely by circumstances outside our reasonable control.

If you purchase products as a consumer, we are not responsible for business losses, including loss of profit, revenue, business opportunity or commercial interruption arising from products purchased primarily for personal or household purposes.

We are not responsible for damage resulting from misuse of a product, use contrary to supplied instructions, unauthorised modification or ordinary wear and tear, except where applicable law provides otherwise.

Nothing in this section affects any remedy available to you under mandatory consumer protection law.

SECTION 17: CUSTOMER RESPONSIBILITY AND MISUSE

You are responsible for using our website and products lawfully and in accordance with the instructions provided.

You may be responsible for reasonably foreseeable losses suffered by BLUCK Europe as a direct result of fraudulent, unlawful or deliberately abusive use of our Services, to the extent permitted by applicable law.

These Terms and contracts entered into with BLUCK Europe are governed by the laws of Ireland.

However, if you are a consumer resident in another country and mandatory consumer protection laws in your country apply to your purchase, this choice of Irish law does not deprive you of the protection provided by those mandatory laws.

Nothing in these Terms restricts your right to bring a claim before a court that has jurisdiction under applicable law.

Before commencing formal proceedings, we encourage customers to contact us so that we can attempt to resolve any issue directly.

Nothing in this section requires you to use arbitration or alternative dispute resolution where you are not legally required to do so.

Section headings are included for convenience and do not affect the interpretation of these Terms.

These Terms may be made available in multiple languages.

Where translations are provided, they are intended to reflect the same contractual conditions.

Nothing concerning language or translation limits any mandatory rights available to consumers under applicable law.

We may update these Terms from time to time to reflect changes to our Services, business operations or applicable law.

The version applicable to an individual purchase will normally be the version in effect when the relevant order was placed.

Changes published after an order has been accepted will not retrospectively alter the terms of that purchase unless required by law or expressly agreed with you.
